Terms of Service

These Terms of Service (“Terms”) govern your use of the Diatic mobile application (“App”) and the diatic.app website and blog (together, the “Service”), operated by Knoctal (“Knoctal”, “we”, “us”, or “our”), based in Mandi Bahauddin, Pakistan.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Diatic is a diabetes companion app that lets you log glucose readings, scan meals with AI to estimate carbohydrates, glycemic index, and calories, track medicine and insulin doses, and follow gamified habit plans. A free tier is available, alongside optional Premium subscriptions (currently offered monthly and yearly) that unlock additional features.

2. Eligibility and Accounts

You must be able to form a legally binding contract to use the Service. You can create an account with Google Sign-In or with an email address and password; some accounts may be provisioned in advance and later linked to you. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account.

3. Subscriptions and Billing

Premium subscriptions are sold and billed through Google Play Billing and are subject to Google Play's own terms. Subscriptions renew automatically until cancelled. You can manage or cancel your subscription at any time through your Google Play account settings. Refunds are handled according to Google Play's refund policies. We may change Premium pricing or features going forward, and will provide notice of material changes where required.

4. Medical Disclaimer

Diatic organises the information you log; it is not a medical device and does not diagnose, treat, cure, or prevent any disease. Estimates produced by the meal-scanning feature (carbohydrates, glycemic index, calories) are approximations and may be inaccurate. Nothing in the Service is a substitute for professional medical advice. Always consult your doctor before making decisions about medication, insulin doses, or treatment, and never rely on the App alone in a medical emergency.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Attempt to reverse engineer, decompile, or extract the source code of the App, except as permitted by law;
• Scrape, crawl, or use automated means to access the Service in a way that could disrupt it;
• Interfere with or attempt to gain unauthorized access to the Service, other accounts, or our infrastructure;
• Upload content through the Service that is unlawful, infringing, or harmful to others.

6. Your Content

You retain ownership of the data and content you log in the App (such as readings, meals, and photos). You grant us a limited license to store, process, and transmit that content solely to provide and improve the Service, including sending meal photos to Google Gemini for analysis as described in our Privacy Policy.

7. Intellectual Property

The Service, including its design, branding, and underlying software, is owned by Knoctal and protected by applicable intellectual property laws. Except for the limited right to use the Service as intended, nothing in these Terms grants you any rights to our trademarks, logos, or other intellectual property.

8. Third-Party Services

The Service relies on third-party providers, including Google Play, Firebase, Google Gemini, Cloudflare, and Turso. We are not responsible for outages, errors, or changes in these third-party services that affect the Service.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your use poses a risk to the Service, other users, or us.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

11. Limitation of Liability

To the fullest extent permitted by law, Knoctal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the Service.

12. Governing Law

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law principles.

13. Changes to These Terms

We may update these Terms from time to time. Changes take effect when we post the revised Terms and update the “Last updated” date above. Continued use of the Service after a change means you accept the revised Terms.
